By accessing or using the BlueRockHR People Operations Portal and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
BlueRockHR provides a cloud-based people operations platform that includes employee management, hiring pipeline tools, scheduling, training management, performance tracking, and related human resources functionality. The Service is provided "as is" and may be updated, modified, or discontinued at our discretion.
To access the Service, you must sign in using Google authentication or another approved method. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
Employers who subscribe to the Service are responsible for the accuracy of employee data entered into the system, ensuring compliance with applicable labor and employment laws, managing user access and permissions within their organization, and obtaining any required consents from employees for data processing.
Employees using the Service through their employer's account agree to use the Service in accordance with their employer's policies and to keep their account information accurate and up to date.
If you submit a job application through the Service, you represent that all information provided is accurate and complete. You consent to the collection and processing of your application data as described in our Privacy Policy. We are not responsible for hiring decisions made by employers using the Service.
The Service and its original content, features, and functionality are owned by BlueRockHR and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
You retain ownership of any data or content you submit to the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to use, store, and process that content solely for the purpose of providing and improving the Service. We will handle your data in accordance with our Privacy Policy.
The Service may integrate with or contain links to third-party services (such as Google for authentication). Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEROCKHR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
You agree to indemnify and hold harmless BlueRockHR, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will remain in effect.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Missouri.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
